This website is owned and operated by LucidTools Software. These Terms & Conditions (the "Terms") set forth the terms and conditions under which you may use our website, as well as all software and services offered by us.

This website offers video services, including transfer services to digitize VHS, 8mm tapes, and DVD sources into formats that are not dependent upon the original hardware used to record this content. Future offerings also include computer application software.

By using this site, our software, or our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

CHANGES TO THE TERMS

We may revise and update these Terms & Conditions (the "Terms") at our sole discretion. All changes are effective immediately as soon as they are posted online. Clients are encouraged to review the most recent version of these terms whenever new terms are posted. By continuing to use our site or services after new Terms have been posted, you agree to the revised Terms.

COMMERCE

​

When buying an item offered , you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and complete the check-out payment process. 

​

The prices we charge for using our products or services are listed on the website. We reserve the right to change our prices, discounts and promotions for products or services displayed at any time and without notice, and to correct pricing errors that may inadvertently occur.

CONTENT RESTRICTIONS

​

Only NTSC compatible tapes are accepted for processing. PAL tapes are not supported.  

​

We do not accept: 

​

• Broken tapes or those damaged from flooding, or tapes with mold

• Copyrighted materials if you are not the copyright holder

• Content that is illegal, abusive, defamatory, harassing, harmful to reputation, subversive, hateful, obscene, racist, pornographic, indecent, profane, or otherwise objectionable.

You acknowledge that any failure to abide by these restrictions will be cause for a denial of service. 

​

RETURNS AND REFUNDS

​

For any undamaged product, simply return it with any included accessories and packaging with your original receipt (or gift receipt) within 14 days of the date that you receive the product, and we will exchange it or offer a refund based upon the original payment method.

​

For service work, such as our video transfer offerings, if we are unable to remedy your issues with our services to your satisfaction we will refund your payment. 

 

CLOUD ACCESS PLANS

​

Clients who take advantage of our Video Services to transfer their videos to digital formats have the option to keep their videos for a period of time in cloud storage obtained by LucidTools Software. This is provided simply as a convenience feature for clients. 

​

Clients who wish to take advantage of this do so by purchasing either a "Monthly Cloud Access Plan", or an "Annual Cloud Access Plan". Both of these are functionally the same, except that the duration is different and an "Annual Cloud Access Plan" supports a subscription model. In each case there is a limit to the number of videos that can be kept in cloud storage per plan. To increase the limit on the number of videos that can be stored, additional plans must be purchased.

For the purposes of these Terms & Conditions, both of these offerings will be referred to as "Access Plans". Clients who purchase Access Plans for their videos do not own this storage, and do not have direct access to the storage, or to the account used to manage this storage.

​

These Access Plans allow Clients to continue to access their videos using the same mechanism as they did when their videos were initial converted, i.e. via Internet URL Links that are provided for each video, for the term specified when the Access Plan is purchased. 

​

When the duration for an Access Plan ends, this terminates access to the specific video for which the Access  Plan was purchased. Clients may extend the term by purchasing additional Access Plan(s) prior to the termination date. The newly purchased Access Plan(s) will start automatically at the conclusion of the preceding Access Plan.

INTELLECTUAL PROPERTY

​

This website, and all materials therein or transferred thereby except as noted herein, including software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of LucidTools Software.

​

Except as explicitly provided herein, nothing in these terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof. 

​

CLIENT INTELLECTUAL PROPERTY

​

Video, audio, music, and photographic content that is provided to LucidTools Software for the purpose of digital conversion remains the sole property of the client. We take no intellectual property ownership in these materials, and they will be returned upon completion of the services.
